Many people trip or slip and fall. Most of the time the only injury is to their pride. Sometimes, however, people sustain injuries that require medical care and even hospitalization. If a trip or fall that results in injury is caused by a property owner's negligence, the injured person may be entitled to recover their damages from the property owner or the owner's insurance. These damages may include past and future medical expenses, lost income, reduction of future earning ability, disability and loss of enjoyment of normal life activities.
It is a common misconception that a property owner is automatically responsible to pay for medical bills of someone injured on their property. That is not accurate. In order for a property owner to be legally responsible for injuries occurring on their property, the injured person must prove that the owner was negligent. The Arizona jury instruction for slip and fall or trip and fall cases (legally known as premises liability cases) requires that the injured person prove that they were injured by an “unreasonable dangerous condition” on the property. The injured person must also prove that the property owner created the dangerous condition, knew about it and failed to remove it or warn about it, or should have known about it. Dogs make wonderful pets but some dogs are capable of causing serious injuries to people. The Arizona legislature recognized this fact and enacted laws that make dog owners legally responsible for injuries caused by their dogs. The definitions, defenses, deadlines and other details of the dog bite laws can be complex and confusing. Most homeowner’s insurance policies will pay for dog bite claims but may have exceptions and conditions. People who live outside of Arizona are often surprised to find out how many boat owners and boating opportunities there are in our state. There are rules for boat operators just like there are for car drivers. Some boat operators don't understand or follow those rules and boat accidents result. There are laws that prohibit operating a boat under the influence of alcohol very similar to those that prohibit driving under the influence of alcohol.
